Terms of Use

These Snowday Embed Terms govern your organization's use of any Snowday embed, iframe, widget, code snippet, or similar embedded experience provided by Snowday, referred to below as the “Embed.” By requesting, installing, displaying, or using the Embed, you agree to these Terms on behalf of yourself and the organization you represent.
1. Permission to Use the Embed. Snowday grants your organization a limited, non-exclusive, non-transferable, revocable permission to display the Embed on the website, webpage, or domain approved by Snowday. You may use the Embed only for the purpose of helping students, families, counselors, or other users access Snowday’s resources and search tools. You may not sell, sublicense, distribute, or otherwise make the Embed available to another organization without Snowday’s written permission.

2. Approved Placement. You may display the Embed only on the website, webpage, or domain you identify to Snowday or that Snowday otherwise approves. You may not place the Embed on any page or in any context that is unlawful, deceptive, harmful, discriminatory, exploitative, unsafe, or likely to harm Snowday’s reputation or user trust. Snowday may ask you to move, modify, or remove the Embed at any time.

3. No Misrepresentation. You may not state or imply that Snowday endorses, certifies, sponsors, approves, exclusively partners with, or is formally affiliated with your organization unless Snowday has specifically approved that language in writing. You may not describe the Embed in a way that is misleading or inconsistent with Snowday’s approved descriptions. You may not make unapproved claims about Snowday, the Embed, counseling outcomes, admissions outcomes, student results, program quality, rankings, recommendations, or user benefits.

4. Brand Use. You may use Snowday’s name, logo, and approved descriptions only in connection with the Embed and only in a manner approved by Snowday. You may not alter Snowday’s name, logo, branding, attribution, disclaimers, or other materials without Snowday’s written permission. Snowday may require changes to your use of its name, logo, or descriptions at any time.

5. No Modification, Interference, or Misuse. You may not modify, copy, scrape, reverse engineer, or attempt to extract data from the Embed; remove, obscure, or alter Snowday branding, attribution, notices, or disclaimers; overlay, frame, surround, or present the Embed in a way that is deceptive or misleading; interfere with the operation, security, performance, or availability of the Embed; use the Embed to develop or support a competing product or service; use automated tools, bots, or scripts to access, query, copy, or manipulate the Embed; or use the Embed in any way that violates applicable law or Snowday’s policies.

6. Responsibility for Your Site. You are responsible for your own website, webpage, surrounding content, marketing copy, services, users, data collection, cookies, analytics, privacy notices, legal compliance, and any claims you make about your organization or services. Snowday is not responsible for your website or for any content, claims, conduct, products, services, or data practices outside the Snowday Embed.

7. Privacy and Data. Snowday’s own privacy practices apply to data Snowday collects through the Embed. You remain responsible for your own website’s privacy notices, cookie notices, analytics tools, tracking technologies, user consents, and compliance with applicable privacy laws. You may not use the Embed in a way that causes Snowday to collect personal information without appropriate notice or consent where required.

8. No Professional Advice or Guaranteed Outcomes. The Embed is provided as an informational resource. Unless Snowday expressly states otherwise in writing, the Embed does not provide professional counseling, legal, medical, psychological, educational, admissions, or other professional advice. Snowday does not guarantee any particular student, counseling, admissions, educational, program, or other outcome.

9. Availability and Changes. Snowday may change, update, limit, suspend, discontinue, or remove the Embed at any time. Snowday does not promise that the Embed will always be available, uninterrupted, secure, error-free, complete, or unchanged. The Embed is provided “as is” and “as available.”

10. Right to Suspend or Terminate Access. Snowday may suspend, disable, modify, or terminate access to the Embed at any time, with or without notice, including if Snowday believes the Embed is being used in a manner that violates these Terms, misrepresents Snowday or its services, creates legal, privacy, safety, security, reputational, or operational risk, or is otherwise inconsistent with Snowday’s policies or mission. If Snowday asks you to remove the Embed or change how it is presented, you agree to do so promptly.

11. Compliance with Laws. You agree to comply with all applicable laws, rules, and regulations in connection with your use of the Embed, your website, your services, and your communications about Snowday.

12. Indemnity. You agree to be responsible for, and to indemnify and hold harmless Snowday and its officers, directors, employees, contractors, and representatives from, any claims, losses, damages, liabilities, costs, or expenses arising out of or related to your website or services; your use or misuse of the Embed; your statements, claims, or representations about Snowday or the Embed; your violation of these Terms; your violation of applicable law; or your privacy, data, cookie, analytics, or user-consent practices.

13. Termination. You may stop using the Embed at any time by removing it from your website. Snowday may terminate your permission to use the Embed at any time. Upon termination, you must promptly remove the Embed and any misleading references to Snowday from your website and materials.

14. Updates to These Terms. Snowday may update these Terms from time to time. If Snowday provides updated Terms or makes them available to you, your continued use of the Embed means you accept the updated Terms.
